Terms of service

These Terms and Conditions (T&C) govern all orders and deliveries made through the BYTEN online shop (www.byten.ch).
By placing an order, you accept these T&C.

SECTION 1 - SELLER / CONTRACTING PARTY
BYTEN
Owner: Manuel Santschi
support@byten.ch

SECTION 2 - SCOPE
These T&C apply to all offers, orders and contracts made through our shop. Deviating terms and conditions of customers are not accepted unless we expressly agree to them in writing.

SECTION 3 - OFFER & PRODUCT PRESENTATION
Colours and finishes may differ from the actual products depending on your display, screen settings or lighting. All stated measurements are approximate values; minor deviations are possible. Some of our products are only available in limited quantities and are generally supplied only while stocks last.

SECTION 4 - ORDER PROCESS & CONCLUSION OF CONTRACT
By clicking "Buy", you place a binding order. The purchase contract is concluded as soon as we expressly confirm your order by e-mail or ship the goods.

SECTION 5 - PRICES & SHIPPING COSTS
All prices are in Swiss francs (CHF) and include any applicable statutory charges. Shipping within Switzerland costs CHF 9.00 for standard shipping. For international deliveries, additional customs duties and import charges may apply, which are to be borne by the recipient.

Before the order process is completed, prices, shipping costs and tax rates may be adjusted, for example due to legal changes or obvious pricing errors. The price displayed at checkout is binding in each case.

SECTION 6 - PAYMENT METHODS
We accept the payment methods shown at checkout, currently Visa, Mastercard, Apple Pay and Google Pay. Additional payment methods such as TWINT will follow. No additional fees are charged for any payment method. Your payment method is charged immediately after the order is completed, in accordance with the payment provider. We do not offer purchase on invoice. All orders are paid directly in the online shop (checkout).

SECTION 7 - DELIVERY & SHIPPING
Information on delivery times, shipping conditions, tracking, international deliveries as well as customs and shipping costs can be found in our Shipping & Delivery Policy (see Section 35).

SECTION 8 - RETENTION OF TITLE
The goods remain the property of BYTEN until they have been paid for in full.

SECTION 9 - INSPECTION OF DELIVERY
Please inspect your delivery immediately upon receipt. Section 34 (Withdrawal & Return Policy) applies to the reporting and handling of defects, incorrect deliveries or transport damage.

SECTION 10 - WARRANTY & LIABILITY
The statutory warranty provisions apply. Excluded from the warranty is damage caused by normal wear and tear, improper handling, lack of care or external influences.

Liability claims against BYTEN are - to the extent permitted by law - limited to direct and foreseeable damage and shall not exceed the purchase price of the product concerned.

SECTION 11 - VOUCHERS & DISCOUNT CODES
Unless expressly stated otherwise, only one discount code can be redeemed per order. Vouchers and discount codes cannot be combined, cannot be paid out in cash and cannot be applied retroactively to orders that have already been completed.

SECTION 12 - RETURNS / WITHDRAWAL
Returns and withdrawal are governed by the provisions of our Withdrawal & Return Policy (see Section 34). Mandatory statutory rights remain unaffected.

SECTION 13 - DATA PROTECTION
Our Privacy Policy applies (see Section 36). Shopify may store and process personal data on servers outside Switzerland.

SECTION 14 - APPLICABLE LAW & AMENDMENTS
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). To the extent permitted by law, the place of jurisdiction is the registered domicile of BYTEN. BYTEN may amend these T&C at any time. The version valid at the time of the order is decisive.

SECTION 15 - REFUSAL & CANCELLATION OF ORDERS
We may refuse orders in whole or in part, or cancel them after confirmation, in particular in the event of: unavailability, pricing or description errors, incorrect information, suspected fraud, exceeding of quantity limits, a delivery address outside our delivery area or failed payment authorisation. Payments already made will be refunded.

SECTION 16 - PRICING AND OFFER ERRORS
Despite due care, pricing or description errors may occur. In the event of obvious errors, we are entitled to withdraw from the contract. Payments made will be refunded.

SECTION 17 - DELIVERY TIMES, PARTIAL DELIVERIES & ACCEPTANCE
Delivery times are non-binding estimates. Partial deliveries are permitted.

SECTION 18 - TRANSFER OF RISK
The risk of loss or damage passes to you upon delivery. If you expressly request your own transport solution or collection, the risk passes upon handover to the carrier.

SECTION 19 - USE & QUANTITY LIMITS
Our products are intended for private use. We may limit order quantities per item/order and cancel orders with an evident resale purpose.

SECTION 20 - ASSIGNMENT
We may transfer rights and obligations under the contract to third parties, provided your legitimate interests are not adversely affected. Your claims under the contract may not be assigned without our consent.

SECTION 21 - SEVERABILITY
Should any provision of these T&C be invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the applicable statutory provision.

SECTION 22 - NO WAIVER
If we refrain from enforcing a right, this does not constitute a waiver of that right. A waiver is only effective if expressly declared.

SECTION 23 - ENTIRE AGREEMENT
These T&C, together with the order confirmation, constitute the entire agreement between you and us regarding the purchase in the shop. Any deviations must be made in writing.

SECTION 24 - STOCK DISCREPANCIES & TECHNICAL ERRORS
Despite careful inventory management, technical errors, synchronisation problems or stock discrepancies may occur. Should an ordered item exceptionally be unavailable after the contract has been concluded, we are entitled to withdraw from the contract. Payments already made will be refunded in full. Further claims are excluded to the extent permitted by law.

SECTION 25 - AUTOMATED ORDERS / BOTS
The use of bots, scripts, automated purchasing programs or other technical means to circumvent order, quantity or access restrictions is prohibited. We reserve the right to cancel such orders without prior notice.

SECTION 26 - FRAUD PREVENTION & VERIFICATION
We reserve the right to refuse or cancel orders, or to request additional proof for verification, in cases of suspected fraud, misuse, incomplete or contradictory information, unusual order patterns or other security concerns.

SECTION 27 - DISCOUNT CODES & MISUSE
Discount codes, voucher codes and special promotions may not be misused, sold, published, reproduced or used in an automated manner. In the event of misuse, we reserve the right to cancel affected orders and revoke granted discounts.

SECTION 28 - UNCOLLECTED OR REFUSED SHIPMENTS
Shipments that are not collected, refused or undeliverable are governed by the provisions of our Shipping & Delivery Policy (see Section 35, section "Undeliverable / Delivery refused").

SECTION 29 - ACCURACY OF THE DELIVERY ADDRESS
The customer is obliged to provide a complete and correct delivery address. We accept no liability for delays, misdeliveries or additional costs resulting from incorrect or incomplete information. Any additional costs incurred may be passed on to the customer.

SECTION 30 - PRODUCT IMAGES & COLOUR REPRESENTATION
Product images are for illustration purposes. Due to differences in screen displays, lighting conditions, production batches or material properties, minor deviations in colour, texture, size or finish may occur. Such deviations do not constitute a defect.

SECTION 31 - THIRD-PARTY PROVIDERS
The services of third-party providers, in particular payment providers, shipping companies, logistics partners or other external service providers, are subject to their own contractual and usage terms. To the extent permitted by law, we accept no liability for their services, delays or failures.

SECTION 32 - MISUSE OF THE SHOP
Any misuse of the shop, any unlawful use or any use that impairs the operation of the shop is prohibited. We reserve the right to refuse orders, restrict customer accounts or take further legal action.

SECTION 33 - EXTENDED FORCE MAJEURE
Events of force majeure include in particular natural events, pandemics, epidemics, official measures, strikes, war, terrorism, cyberattacks, failures of telecommunications, IT, payment or logistics systems, as well as other events beyond our control. For the duration of such events, our performance obligations are suspended to a reasonable extent. Claims for damages are excluded to the extent permitted by law.

SECTION 34 - WITHDRAWAL & RETURN POLICY
Returns within 14 days
You can return items within 14 days of delivery. Register your return in advance by e-mail to support@byten.ch, stating your order number and the items concerned. We will then send you the return address and the next steps.

Conditions
Returned items must be unworn, unwashed, unaltered and undamaged, and must be in their original packaging with all tags attached. Items that do not meet these conditions may be excluded from the refund.
Personalised products and hygiene-sensitive items, in particular underwear, are excluded from returns to the extent permitted by law. This does not apply in the case of justified defects.

Costs & risk of the return shipment
You bear the costs and risk of the return shipment. We recommend using a shipping method with tracking; we accept no liability for shipments lost or damaged on the way back. The original shipping costs will not be refunded. Refusing to accept a shipment or failing to collect it does not constitute a return (see Section 35, section "Undeliverable / Delivery refused").

Refund
After receiving and inspecting your return, we will refund the value of the returned items to the payment method originally used, usually within 14 days. We do not offer exchanges or store credit - if you would like a different size or a different item, simply place a new order.

Customs & fees for international returns
If customs duties, import charges or other fees are incurred on a return shipment from abroad that we have to pay when the parcel arrives, we may deduct these costs from the refund.

Defects, incorrect deliveries & transport damage
If an item is defective upon receipt, has been delivered incorrectly or has been damaged in transit, we will of course take care of an appropriate solution. Report such cases to support@byten.ch within 5 days of delivery. Please include your order number, meaningful photos and a short description of the problem. In the case of transport damage, we also need photos of the packaging.

In the case of justified defects, the solution will be provided at our discretion through a replacement delivery, rectification, exchange or - where necessary - a refund. In these cases, we will of course also cover the costs of the return shipment.
We reserve the right to examine the reported defects and to decide on the appropriate form of remedy.

SECTION 35 - SHIPPING & DELIVERY
Delivery area
- Currently: Switzerland (standard shipping with Swiss Post).
- International: in preparation - we will provide information here as soon as it becomes available.

Shipping costs
- Switzerland: CHF 9.00 shipping costs (standard).

Delivery times
- Switzerland: Usually 2-5 working days after order confirmation or dispatch.
- International deliveries (as soon as available): Usually 5-10 working days after dispatch. The actual delivery time may vary depending on the destination country, customs clearance and local shipping providers.
- All stated delivery times are approximate values and non-binding estimates. Longer delivery times may occur, in particular in the case of high demand, limited drops, pre-orders, increased order volumes or delays at shipping and logistics providers.
- We make every effort to process and ship all orders as quickly as possible.

Tracking
You will receive a tracking number as soon as your order has been shipped.

Customs, import charges and taxes
For international orders, additional customs fees, import charges, taxes or other official fees may apply. These costs are to be borne by the recipient. The applicable regulations vary from country to country. We have no influence on these fees and cannot predict their amount.

Undeliverable / Delivery refused
If a shipment is not delivered, not collected, refused or returned to us due to an incorrectly or incompletely provided delivery address, the resulting shipping, return, customs, storage and handling costs may be deducted from any refund or passed on to the customer.

SECTION 36 - PRIVACY POLICY
Protecting your data matters to us. At BYTEN, one simple principle applies: We only collect what we really need for the shop - and we don't sell data. Period.

We process personal data in accordance with Swiss data protection law (revFADP) and - where applicable - comparable international standards.

Data controller
BYTEN
Owner: Manuel Santschi
support@byten.ch

What data we process
Depending on how you use our shop, the following data may be collected:
- Master data: name, address, contact details
- Order and contract data: ordered products, delivery and billing address, order history
- Payment data: e.g. masked card details and transaction IDs. The payment itself is handled by our payment providers - we never see full card details.
- Communication data: e-mails and support requests to support@byten.ch
- Newsletter: your e-mail address, if you have subscribed
- Technical usage data: server logs, IP address, timestamps - only to the extent necessary for the operation and security of the shop

What we need your data for
- Processing your order and payment
- Shipping and delivery
- Customer communication and support
- Newsletter, if you have subscribed to it
- Operation, security and improvement of the shop
- Protection against fraud and misuse
- Compliance with legal obligations (e.g. retention of records)
Depending on the purpose, we rely on the processing of your purchase, on your consent (e.g. newsletter - revocable at any time via the unsubscribe link), on our interest in a secure and functioning shop, or on legal obligations.

Who else receives data
No online shop runs without partners. The following come into contact with your data:

- Shopify - our shop platform (hosting and operation)
- Payment providers - for TWINT, card and wallet payments
- Swiss Post - for shipping

These service providers process data partly on our behalf and partly under their own responsibility (e.g. for payment processing). Beyond that, we only pass on data if we are legally obliged to do so, if it is necessary to enforce our T&C or to prevent fraud - or if BYTEN were ever to be transferred and the customer data belongs to the transferred business.

Data abroad
Shopify and our payment providers may also store and process data on servers outside Switzerland, possibly in countries with less strict data protection. In such cases, we ensure - where necessary - appropriate safeguards, in particular through recognised standard contractual clauses. If you have any questions about this, please get in touch with us.

Cookies
We currently do not use any marketing or analytics cookies. Technically necessary cookies (shopping cart, checkout, language settings, security) may be set by the shop platform. Should this change, we will inform you transparently here and - where necessary - obtain your consent.

How long we keep data
Only as long as necessary for the purposes stated or as required by law (accounting records, for example, ten years). After that, we delete or anonymise the data. If you unsubscribe from the newsletter, your e-mail address remains on a suppression list - solely to make sure we no longer send you anything.

Security
We protect your data with appropriate technical and organisational measures. Let's be honest: there is no such thing as one hundred percent security on the internet - but we do what we can.

Minors
Our offering is not directed at children. We do not knowingly collect personal data from children.

Your rights
Within the scope of applicable law, you can at any time:

- request information about what data we hold about you
- have incorrect data corrected
- have your data deleted, provided no retention obligations exist
- restrict or object to the processing
- request certain data in a common format

An e-mail to support@byten.ch is all it takes. For security reasons, we may first ask for proof of identity. And if you feel we are not handling your data correctly: tell us first - we will sort it out directly. Regardless of this, you can contact the Swiss Federal Data Protection and Information Commissioner (FDPIC).

Third-party links
Our website may link to external services (e.g. Instagram). The privacy policies of the respective provider apply there - we cannot accept any responsibility for them.

Amendments
We may amend this Privacy Policy at any time. The version published here at the time applies.
